This information is to help you operate a mobile shop within the Timaru District Council and MacKenzie District.
It provides information on the relevant standards required and the application and registration
procedures.
The following section lists other Council units that may have an interest in, or requirements relating to your proposed business. They may also provide
further technical advice or information you may need to consider before proceeding with any venture.
1. TIMARU DISTRICT COUNCIL
Telephone 687-7200.
(i) Environmental Health Unit.
For information on legislative requirements and bylaws regarding mobile shops and stall licences.
If your business involves the storage and/or supply of gas for cooking or heatingwater.
(iii) Bylaws Officer.
For advice on sites on streets.
(iv) Parks and Reserves.
For advice regarding sites in parks or reserves and Council organised events.
LEGAL REQUIREMENTS
"mobile shop" means a vehicle, whether self-propelled or not, from which goods are offered or exposed for sale or from which goods may be ordered or from which services are offered for sale but does not include any vehicle from which food is sold for consumption in or at the vehicle, or any vehicle used for the purpose of transporting and delivering goods pursuant to a prior order placed for the delivery of such goods.
If food is to be sold from the mobile shop, then it must comply with the requirements of the Food Hygiene Regulations 1974 and be registered with the Council.
If they are to be used in, or occupy, any street, road or other public place, the vehicle must have a current warrant of fitness and vehicle registration. All other licences or permits and any site fees which may be required under the provisions of any relevant Act, Regulation or Bylaw must be paid and current. A letter of aurthorisation to operate on a state highway is required from Transit New Zealand and this letter is required to be provided to the Timaru District Council.
